The Appeals Council

If you are requesting a review by the Social Security Appeals Council, it has now been two years or more since you first applied for benefits. Understandably, you are doubtful that you will ever qualify for benefits. However, the judge in your administrative law judge hearing may have made a mistake in denying your claim. The Appeals Council is a three-member panel that will determined if the ALJ judge made an error of law or an error of fact in your case.

There are three possible outcomes:

(1) The Appeals Council may deny your request for review
(2) The Council may remand your case back to the ALJ judge for a new decision. In this case, the judge will often reverse his/her decision and grant your Social Security Disability benefits.
(3) The Appeals Council has authority to grant your benefits directly if it determines the evidence clearly indicates a disability which prevents you from working.
