The Administrative Law Judge HearingIf you have been turned down for SSDI or SSI after the second submission of your claim, the Social Security Administration provides a hearing before an SSA judge. You have 60 days from receiving the Notification of Denial on Reconsideration to request a hearing. This is your first chance to talk face-to-face with a real person to explain why you are disabled and cannot return to work. You should certainly have legal counsel for the administrative law judge hearing. The Social Security Disability Law Firm, P.A. will prepare you for your ALJ hearing and represent you when you appear before the judge. This is your chance to present evidence of your disability, including new documentation from your doctor(s). On average, only about 50 percent of people succeed at the hearing level. Our attorney, Chris R. Borgia, has a much higher success rate. Our firm handles only Social Security Disability claims, and our staff includes former SSA employees. We know what the law requires and we know which points to stress to convince the judge of your disability. Mr. Borgia also prepares a legal brief for the judge summarizing your work and medical history, making it easier for the ALJ judge to decide your case. How Long Does It Take? It typically takes 12 to 18 months from the date of denial to get an administrative law judge hearing. In the meantime, we track your medical treatment to provide the best evidence to the judge when your case comes up for hearing. Although you will get back benefits if you are eventually approved for benefits, we understand that the long wait can lead to financial hardship. We can tell you if you qualify as a Dire Need case for expedited processing by the SSA. What If the Judge Rules Against Me?If the administrative judge rejects your claim, we can take your case to the Appeals Council for review.
